IPO Provides Public Access to Online Database of Patent Examinations And Adopts Protective Measures for Personal Data

1. To improve the access to the information of patent examinations and relieve the burden of files inspection to the public, an internet browsing of examination data of patent applications that have been laid open under the law has been provided by the Intellectual Property Office of Taiwan (TIPO) since March 1, 2011. The scope of the online search extends to the invention patent applications not yet issued the first office action but have been laid open as of March 1, 2011.

2. The items of the information of invention patent examinations which can be browsed online are listed as follows:
(a) The profile of the application (including application number, publication number, issuing number, the date of the application, the title of the application, the status of the application, the patentee's name, the attorney's name, the claim of the priority and so on)
(b) The request of the patent application (text file)
(c) The amended sheet(s) of the specification on which the portions of supplement or amendment are underlined (image file)
(d) The replacement sheet(s) of specification or drawings without underlines (image file)
(e) Grounds for supplement and amendment (image file)
(f) Grounds for response (image file)
(g) Grounds for amendment (image file)
(h) Grounds for re-examination (image file)
(i) The divisional application (image file)
(j) Grounds for conversion (image file)
(k) The original specification in any language (image file)
(l) The copy of notification letters from TIPO (image file)
(m) The copy of notification attachments from TIPO (image file) (including the search report)

3. For the protection of personal data, TIPO will not reveal the information inappropriate to be published in Patent Gazettes and ledgers of laid-open applications. For example, applicants' national identification numbers, telephone numbers, facsimile numbers, E-mail addresses, name stamps and signatures will be withheld.

4.The application form issued by TIPO should be used to avoid accidentally providing any unnecessary personal data when patentees and attorneys file a patent application. Furthermore, personal information should not be shown in attachments such as specifications and drawings lest published image files should harm individual rights and interests.
